This website (https://shopcasadeoro.com, the “Site”) is operated by Casa De Oro Resortwear LLC, a Nevada limited-liability company registered to do business in California (“Casa De Oro,” “we,” “us,” “our”). By accessing the Site, creating an account, or purchasing any product (collectively, the “Services”), you (“Customer,” “you,” “your”) agree to be bound by:

2. Eligibility & Accounts

  • Age & Capacity — You must be 18 years or older and legally capable of forming a binding contract.
  • Territories — We ship to all U.S. jurisdictions except those subject to U.S. trade embargoes or sanctions (e.g., Cuba, Iran, North Korea, Syria, Crimea).
  • Accounts — Guest checkout is available. Account creation is optional and granted at our sole discretion; you are responsible for all activity under your credentials.

3. Governing Law & Dispute Resolution

  1. Governing Law — These Terms are governed by the laws of Nevada and, where applicable, the U.S. Federal Arbitration Act.
  2. Mandatory Arbitration — Any dispute arising out of or relating to these Terms, the Site, or an Order shall be finally resolved by binding arbitration administered by JAMS under its Consumer Arbitration Rules. The hearing will be held in Las Vegas, Nevada, or by video at the arbitrator’s discretion.
  3. Class & Jury Waiver — YOU AND CASA DE ORO WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
  4. Small-Claims & IP Relief — Either party may (i) bring an individual action in small-claims court or (ii) seek injunctive or equitable relief in court to protect intellectual-property or confidential-information rights.

4. Sales, Payments & Pricing

  • Accepted Payments — Visa, MasterCard, American Express, Discover, PayPal, Apple Pay, Google Pay, and Casa De Oro gift cards. You authorize us (or our processor) to charge the full Order total, including taxes and shipping.
  • Pre-Orders; No Subscriptions — We may offer clearly labeled pre-order Products. No subscriptions or layaway are offered at this time.
  • Pricing Errors — If an advertised price deviates by more than 5 % due to error, we may cancel the Order and issue a full refund.
  • Tax & Risk of Loss — Sales tax is calculated at checkout. Title and risk of loss pass to you when the carrier takes possession of the shipment.

5. Incorporated Policies

These Policies are incorporated by reference and may be updated as stated therein.

6. Intellectual Property & User Content

  1. Ownership — All Content is owned by Casa De Oro or its licensors and protected by U.S. and international laws. We grant you a limited, non-exclusive, non-transferable licence to access the Site for personal, non-commercial use.
  2. User Content Licence — By submitting User Content you grant Casa De Oro a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, translate, and distribute the material in any medium, and you waive any moral rights in such content.
  3. Moderation — We may edit, refuse to post, or remove any User Content at our sole discretion.

7. Prohibited Conduct

  • Use bots, scraping tools, or data-mining techniques on the Site.
  • Submit fake, incentivised, or paid reviews.

  • Tamper with the Site’s security or integrity.

8. Force Majeure

Neither party is liable for delay or failure to perform caused by events beyond reasonable control, including natural disasters, pandemics, labour disputes, carrier failures, governmental orders, or internet outages.

9. Disclaimers & Limitation of Liability

  1. Product Disclaimers
    • Fit & Sizing — Sizes are approximate; actual fit may vary up to one size.
    • Colour — Colours may differ due to lighting and screen settings.
    • No Health Claims — Products are for comfort and style; no medical benefits are claimed.
  2. “AS IS.” Except as expressly stated, the Site and Products are provided “AS IS” without warranties of any kind, express or implied.
  3. Liability Cap. IN NO EVENT will Casa De Oro’s aggregate liability exceed the total amount you paid us in the twelve (12) months preceding the claim, regardless of theory of liability. Where such limitation is disallowed, it applies to the maximum extent permitted.

10. Indemnification

You agree to indemnify, defend, and hold harmless Casa De Oro Resortwear LLC and its officers, directors, employees, agents, affiliates, and successors from any claim, loss, damage, liability, cost, or expense (including reasonable attorneys’ fees) arising from or relating to:

  1. your breach of these Terms or any Policy;
  2. your misuse of the Site or Products;
  3. your violation of law or third-party rights; or
  4. User Content you submit.

11. Modification & Termination

  1. Changes — Material changes take effect 30 days after notice by email and banner. Non-material changes are effective upon posting.
  2. Termination — We may suspend or terminate your access immediately for any violation. Obligations accrued before termination (including payment and indemnification) survive.

12. Severability • Waiver • Assignment

  • If any provision is held unenforceable, the remainder remains in effect.
  • Our failure to enforce any right is not a waiver of future enforcement.
  • We may assign these Terms without notice; you may not assign your rights or obligations.

13. Entire Agreement

These Terms and the incorporated Policies constitute the entire agreement between you and Casa De Oro and supersede all prior agreements regarding the Services.
